Pactos, acuerdos y consentimientos: el derecho canónico y el manejo cotidianos de los conflictos en Hispanoamérica

Esta breve exposición es parte de la pesquisa para la escritura de la voz “Pactos” en el Diccionario Histórico de Derecho Canónico en Hispanoamérica y Filipinas (DCH). Allí se analizan los diferentes debates sobre el origen tanto moral como jurídico de los acuerdos y pactos. Desde la óptica de los juristas hispanoamericanos del s. XVI se intenta desentrañar su configuración jurídica. Para ello, se reconocerán elementos fundamentales de los mismos, como la forma de prestar consentimiento, su perfeccionamiento, clasificaciones, usos cotidianos y finalmente los debates sobre los diferentes pactos posibles con el demonio.

This brief exposition is part of the research for the writing of the entry "Pactos" in the “Historical Dictionary of Canon Law in Hispanic America and the Philippines, 16th -18th century (DCH)”. It analyzes different debates on the moral and legal origins of the agreements. From the point of view of the Hispanic-American jurists of the 16th century, it also attempts to understand their juridical configuration. To this end, fundamental elements are identified, such as the form of consent, its refinement, classifications, daily uses and finally the debates on the different possible pacts with the devil.
